# Workplace violence training records that answer the question

Every rule ends in the same place: show who was trained, by whom, and what they can do.

United States

## What a California record must show

California’s [general workplace violence law](https://peopletechrevolution.com/learn/standards/california-sb-553-training) is the most specific about the record itself, so it makes a good template elsewhere.

### What each record holds

[California Labor Code section 6401.9](https://leginfo.legislature.ca.gov/faces/codes_displaySection.xhtml?lawCode=LAB&sectionNum=6401.9) requires training dates, the contents or a summary of each session, the names and qualifications of the trainers, and the names and job titles of everyone who attended. Trainer qualifications is the field to check first in any completion export.

### How long, and how fast

Training records are kept for at least one year. Hazard records, violent incident logs and investigation records are kept for at least five years. Employees and their representatives can ask for them and receive them within fifteen calendar days, without cost.

### Nevada and the Joint Commission

[Nevada’s medical facility statute](https://www.leg.state.nv.us/nrs/NRS-618.html) requires a record of each training session, with no personally identifiable information of any patient or employee. For hospitals, the [Joint Commission’s workplace violence goal](https://www.jointcommission.org/en-us/standards/national-performance-goals/preventing-workplace-violence) requires documentation of the training.

### Federal rules: proof of competence

In [psychiatric residential treatment facilities](https://www.ecfr.gov/current/title-42/chapter-IV/subchapter-G/part-483/subpart-G/section-483.376), staff “successfully demonstrate in practice the techniques they have learned”. The record carries the date and the name of the person certifying completion.

Australia

## What Australian hospitals must show

Hospitals accredited to the [NSQHS Standards](https://www.safetyandquality.gov.au/standards/nsqhs-standards/clinical-governance-standard) answer the same question through their training systems.

### Mandatory training, monitored

The [Clinical Governance Standard](https://www.safetyandquality.gov.au/standards/nsqhs-standards/clinical-governance-standard) asks a health service to implement a mandatory training program and to monitor the workforce’s participation in training. ### How long must training records be kept?

In California, at least one year for training records and five for hazard records, incident logs and investigations. Nevada requires a record of each session.
